The present work proposes a critical exploration of the epistemological foundations of modern contractualism, showing how its exclusion criteria operate through language games and the configuration of constitutional order. This critical exercise may improve the understanding of the conditions of possibility for a new social pact sense, in a political context marked by the Chilean popular revolt of 2019. Two consequential effects from above: the resignification of constitutional contents and the beginning of a constituent process.

This paper seeks to highlight the French philosopher Michel Foucault's contributions regarding his analysis of power. In this sense, the text proposes a conceptual transition around the ideas that could have interested the author within a digital context, integrating some notes and examples from the 2019 Chilean mobilizations.The article has an initial section that exposes genealogy as a way of approaching social reality. Then, it shows the social behaviors anticipation possibilities and their relationship with the information available on the web. (...) Más de la mitad de la fuerza laboral mexicana se encuentra en la informalidad. Sin embargo, existe un elevado número de transiciones del empleo informal al empleo formal en el corto plazo, lo que se ha interpretado como evidencia de que la informalidad es una decisión óptima para incrementar el bienestar. El objetivo de este trabajo es analizar las condiciones de ingreso y estabilidad laboral de los empleados que se insertan a la formalidad, después de iniciar su trayectoria laboral en (...) la informalidad. Se utiliza el Módulo de Trayectorias Laborales (MOTRAL) 2015, encuesta con representatividad nacional de las zonas urbanas mexicanas. Para ello se comparan las condiciones de ingreso y la estabilidad laboral en 2010 entre los trabajadores formales utilizando dos grupos: quienes tuvieron su primer empleo en la informalidad y quienes tuvieron su primer empleo en la formalidad. Se construyen matrices de transición entre el primer empleo, el empleo en 2010, y en 2015 para corroborar la alta movilidad encontrada por la literatura previa; posteriormente se analizan con modelos multivariados las condiciones de ingreso y la estabilidad laboral. Los resultados indican que una proporción significativa de quienes se iniciaron en la informalidad acceden posteriormente a empleos formales. Sin embargo, se encuentra que el acceso al empleo formal desde la informalidad ocurre en condiciones de desventajas en ingresos y contratación de largo plazo, sin que las desventajas desaparezcan posteriormente, por lo que el inicio de la vida laboral en la informalidad está asociado a desventajas permanentes en el mercado de trabajo. En este artículo se pretende exponer la antropología de Eugenio Trías como clave de comprensión de toda su filosofía. Para ello se estudia primero su ontología, en torno al ser del límite, y los tres cercos: cerco del aparecer, cerco hermético y cerco del límite. En un segundo momento se estudia su antropología filosófica, propiamente dicha, que analiza al hombre como habitante de la frontera o ser fronterizo. El hombre es entendido como un límite entre lo divino y lo animal, (...) entre la naturaleza de la que proviene (nacimiento) y el arcano hacia el que se mueve (muerte). Philosophers have long debated whether, if determinism is true, we should hold people morally responsible for their actions since in a deterministic universe, people are arguably not the ultimate source of their actions nor could they have done otherwise if initial conditions and the laws of nature are held fixed. To reveal how non-philosophers ordinarily reason about the conditions for free will, we conducted a cross-cultural and cross-linguistic survey (N = 5,268) spanning twenty countries and sixteen languages. Overall, participants tended (...) to ascribe moral responsibility whether the perpetrator lacked sourcehood or alternate possibilities. However, for American, European, and Middle Eastern participants, being the ultimate source of one’s actions promoted perceptions of free will and control as well as ascriptions of blame and punishment. By contrast, being the source of one’s actions was not particularly salient to Asian participants. Finally, across cultures, participants exhibiting greater cognitive reflection were more likely to view free will as incompatible with causal determinism. We discuss these findings in light of documented cultural differences in the tendency toward dispositional versus situational attributions. (shrink)

In the remainder of this article, we will disarm an important motivation for epistemic contextualism and interest-relative invariantism. We will accomplish this by presenting a stringent test of whether there is a stakes effect on ordinary knowledge ascription. Having shown that, even on a stringent way of testing, stakes fail to impact ordinary knowledge ascription, we will conclude that we should take another look at classical invariantism. Here is how we will proceed. Section 1 lays out some limitations of previous (...) research on stakes. Section 2 presents our study and concludes that there is little evidence for a substantial stakes effect. Section 3 responds to objections. The conclusion clears the way for classical invariantism. Since at least Hume and Kant, philosophers working on the nature of aesthetic judgment have generally agreed that common sense does not treat aesthetic judgments in the same way as typical expressions of subjective preferences—rather, it endows them with intersubjective validity, the property of being right or wrong regardless of disagreement. Moreover, this apparent intersubjective validity has been taken to constitute one of the main explananda for philosophical accounts of aesthetic judgment. But is it really the case that most people (...) spontaneously treat aesthetic judgments as having intersubjective validity? In this paper, we report the results of a cross‐cultural study with over 2,000 respondents spanning 19 countries. Despite significant geographical variations, these results suggest that most people do not treat their own aesthetic judgments as having intersubjective validity. We conclude by discussing the implications of our findings for theories of aesthetic judgment and the purpose of aesthetics in general. (shrink)

Does the Ship of Theseus present a genuine puzzle about persistence due to conflicting intuitions based on “continuity of form” and “continuity of matter” pulling in opposite directions? Philosophers are divided. Some claim that it presents a genuine puzzle but disagree over whether there is a solution. Others claim that there is no puzzle at all since the case has an obvious solution. To assess these proposals, we conducted a cross-cultural study involving nearly 3,000 people across twenty-two countries, speaking eighteen (...) different languages. Our results speak against the proposal that there is no puzzle at all and against the proposal that there is a puzzle but one that has no solution. Our results suggest that there are two criteria—“continuity of form” and “continuity of matter”— that constitute our concept of persistence and these two criteria receive different weightings in settling matters concerning persistence. Background Providing understandable information to patients is necessary to achieve the aims of the Informed Consent process: respecting and promoting patients’ autonomy and protecting patients from harm. In recent decades, new, primarily digital technologies have been used to apply and test innovative formats of Informed Consent. We conducted a systematic review to explore the impact of using digital tools for Informed Consent in both clinical research and in clinical practice. Understanding, satisfaction and participation were compared for digital tools versus the (...) non-digital Informed Consent process. Methods We searched for studies on available electronic databases, including Pubmed, EMBASE, and Cochrane. Studies were identified using specific Mesh-terms/keywords. We included studies, published from January 2012 to October 2020, that focused on the use of digital Informed Consent tools for clinical research, or clinical procedures. Digital interventions were defined as interventions that used multimedia or audio–video to provide information to patients. We classified the interventions into 3 different categories: video only, non-interactive multimedia, and interactive multimedia. Results Our search yielded 19,579 publications. After title and abstract screening 100 studies were retained for full-text analysis, of which 73 publications were included. Studies examined interactive multimedia, non-interactive multimedia, and videos, and most studies were conducted on adults. Innovations in consent were tested for clinical/surgical procedures and clinical research. For research IC, 21 outcomes were explored, with a positive effect on at least one of the studied outcomes being observed in 8/12 studies. For clinical/surgical procedures 49 outcomes were explored, and 21/26 studies reported a positive effect on at least one of the studied outcomes. Conclusions Digital technologies for informed consent were not found to negatively affect any of the outcomes, and overall, multimedia tools seem desirable. Multimedia tools indicated a higher impact than videos only. Presence of a researcher may potentially enhance efficacy of different outcomes in research IC processes. Studies were heterogeneous in design, making evaluation of impact challenging. Robust study design including standardization is needed to conclusively assess impact. (shrink)

Is behavioral integration a necessary feature of belief in folk psychology? Our data from over 5,000 people across 26 samples, spanning 22 countries suggests that it is not. Given the surprising cross-cultural robustness of our findings, we argue that the types of evidence for the ascription of a belief are, at least in some circumstances, lexicographically ordered: assertions are first taken into account, and when an agent sincerely asserts that p, nonlinguistic behavioral evidence is disregarded. Editors have increasing pressure as scholarly publishing tries to shore up trust and reassure academics and the public that traditional peer review is robust, fail-safe, and corrective. Hidden conflicts of interest (COIs) may skew the fairness of the publishing process because they could allow the status of personal or professional relationships to positively influence the outcome of peer review or reduce the processing period of this process. Not all authors have such privileged relationships. In academic journals, editors usually have very (...) specialized skills and are selected as agents of trust, entrusted with the responsibility of serving as quality control gate-keepers during peer review. In many cases, editors form extensive networks, either with other professionals, industry, academic bodies, journals, or publishers. Such networks and relationships may influence their decisions or even their subjectivity towards a set of submitting authors, paper, or institute, ultimately influencing the peer review process. These positions and relationships are not simply aspects of a curriculum, they are potential COIs. Thus, on the editorial board of all academic journals, editors should carry a COI statement that reflects their past history, as well as actual relationships and positions that they have, as these may influence their editorial functions. Within any organization (e.g. a hospital or clinic) the perception of the way things operate may vary dramatically as a function of one’s location in the organizational hierarchy as well as one’s professional discipline. Interorganizational variability depends on organizational coherence, safety, and stability. In this four-nation (Canada, Ireland, Australia, and Korea) qualitative study of 42 nurses, we explored their perception of how ethical decisions are made, the nurses’ hospital role, and the extent to which their voices were heard. These nurses (...) suggested that their voices were silenced (often voluntarily) or were not expressed in terms of ethical decision making. BackgroundMoral distress (MD) is the psychological damage caused when people are forced to witness or carry out actions which go against their fundamental moral values. The main objective was to evaluate the prevalence and predictive factors associated with MD among health professionals during the pandemic and to determine its causes.MethodsA regional, observational and cross-sectional study in a sample of 566 professionals from the Public Health Service of Andalusia (68.7% female; 66.9% physicians) who completed the MMD-HP-SPA scale to determine the level (...) of MD (0-432 points). Five dimensions were used: i) Health care; ii) Therapeutic obstinacy-futility, iii) Interpersonal relations of the Healthcare Team, iv) External pressure; v) Covering up of medical malpractice.ResultsThe mean level of MD was 127.3 (SD=66.7; 95% CI 121.8-132.8), being higher in female (135 vs. 110.3; p<0.01), in nursing professionals (137.8 vs. 122; p<0.01) and in the community setting (136.2 vs. 118.3; p<0.001), with these variables showing statistical significance in the multiple linear regression model (p<0.001; r2=0.052). With similar results, the multiple logistic regression model showed being female was a higher risk factor (OR=2.27; 95% CI 1.5-3.4; p<0.001). 70% of the sources of MD belonged to the dimension "Health Care" and the cause "Having to attend to more patients than I can safely attend to" obtained the highest average value (Mean=9.8; SD=4.9).ConclusionsFemale, nursing professionals, and those from the community setting presented a higher risk of MD. The healthcare model needs to implement an ethical approach to public health issues to alleviate MD among its professionals. (shrink)

This longitudinal study explored patterns of basic psychological needs and self-determined motivation, as well as its association with the teaching style and the physical activity enjoyment in a group of students. The sample consisted of 200 secondary education students (105 girls and 95 boys) aged 11 to 13 years (M= 12.65,SD= 0.79) at the start of the study. Students were assessed twice in a 22 month-period. Descriptive analyses were conducted between major variables at both time points, and to explore the (...) number and nature of clusters, we relied on latent profile analysis. The statistical analyses showed three different patterns: downward, stable and upward, with different outcomes and determinants. The downward pattern was associated with more negative enjoyment and a controlling style, while the upward pattern with more positive enjoyment and autonomy support. This study, which was based on a person-centered approach, provided a bigger picture of the interplay between autonomy, competence, relatedness, self-determined motivation, autonomy/control support, and physical activity enjoyment. Fibromyalgia is a chronic pain syndrome characterized by dysfunctional processing of nociceptive stimulation. Neuroimaging studies have pointed out that pain-related network functioning seems to be altered in these patients. It is thought that this clinical symptomatology may be maintained or even strengthened because of an enhanced expectancy for painful stimuli or its forthcoming appearance. However, neural electrophysiological correlates associated with such attentional mechanisms have been scarcely explored. In the current study, expectancy processes of upcoming laser stimulation (painful and non-painful) and (...) its further processing were explored by event-related potentials (ERPs). Nineteen fibromyalgia patients and twenty healthy control volunteers took part in the experiment. Behavioral measures (reaction times and subjective pain perception) were also collected. We manipulated the pain/no pain expectancy through an S1–S2 paradigm (cue-target). S1 (image: triangle or square) predicted the S2 appearance (laser stimulation: warmth or pinprick sensation). Laser stimuli were delivered using a CO2 laser device. Temporal and spatial principal component analyses were employed to define and quantify the ERP component reliability. Statistical analyses revealed the existence of an abnormal pattern of pain expectancy in patients with fibromyalgia. Specifically, our results showed attenuated amplitudes at posterior lCNV component in anticipation of painful stimulation that was not found in healthy participants. In contrast, although larger P2 amplitudes to painful compared to innocuous events were shown, patients did not show any amplitude change in this laser-evoked response as a function of pain predictive cues (as occurred in the healthy control group). Additionally, analyses of the subjective perception of pain and reaction time indicated that laser stimuli preceded by pain cues were rated as more painful than those signaling non-pain expectancy and were associated with faster responses. Differences between groups were not found. The present findings suggest the presence of dysfunction in pain expectation mechanisms in fibromyalgia that eventually may make it difficult for patients to correctly interpret signs that prevent pain symptoms. Furthermore, the abnormal pattern in pain expectancy displayed by fibromyalgia patients could result in ineffective pain coping strategies. Understanding the neural correlates of pain processing and its modulatory factors is crucial to identify treatments for chronic pain syndromes. (shrink)

IntroductionRheumatologists are the primary healthcare professionals responsible for patients with rheumatic diseases and should acquire medical ethical competencies, such as the informed consent process. The objective clinical structured examination is a valuable tool for assessing clinical competencies. We report the performance of 90 rheumatologist trainees participating in a station designed to evaluate the ICP during the 2018 and 2019 national accreditations.MethodsThe station was validated and represented a medical encounter in which the rheumatologist informed a patient with systemic lupus erythematosus with (...) clinically active nephritis about renal biopsy. A trained patient–actor and an evaluator were instructed to assess ICP skills in obtaining formal informed consent, delivering bad news and overall communication with patients. The evaluator used a tailored checklist and form.ResultsCandidate performance varied with ICP content and was superior for potential benefit information but significantly reduced for potential complications and biopsy description. Only 17.8% of the candidates mentioned the legal perspective of ICP. Death was omitted by the majority of the candidates ; after the patient–actor challenged candidates, only 57.1% of them gave a clear and positive answer. Evaluators frequently rated candidate communications skills as superior, but ≥1 negative aspect was identified in 69% of the candidates.ConclusionsEthical competencies are mandatory for professional rheumatologists. It seems necessary to include an ethics competency framework in the curriculum throughout the rheumatology residency. (shrink)

In order to justify the relevance of the topic, a minimum context is given on the notions of neurodivergence as well as some brief remarks on the neurodiversity advocacy movement. This serves as a basis to establish the importance of increasing the scope of epistemology to include issues that do not fit in the descriptions of typical subjects and cognitive (...) processes. To better understand risk management and mutual aid among American ranchers, we interviewed and mailed a survey to ranchers in Hidalgo County, New Mexico, and Cochise County, Arizona, focusing on two questions: When do ranchers expect repayment for the help they provide others? What determines ranchers’ degrees of involvement in networks of mutual aid, which they refer to as “neighboring”? When needs arise due to unpredictable events, such as injuries, most ranchers reported not expecting to be paid back for the (...) help they provide. When help is provided for something that follows a known schedule or that can be scheduled, such as branding, most ranchers did expect something in return for the help they provide. This pattern makes sense in light of computational modeling that shows that transfers to those in need without expectations of repayment pool risk more effectively than transfers that create debt. Ranchers reported helping other ranchers more often when they belonged to more religious and civic organizations, when they owned larger ranches, when they relied less on ranch vs. other income, and when they had more relatives in the area. Operators of midsize ranches reported helping other ranchers more frequently than did those on smaller and larger ranches. None of our independent variables predicted how many times ranchers reported receiving help from other ranchers. Although ranch culture in the American West is often characterized by an ethic of individualism and independence, our study suggests that this ethic stands alongside an ethic of mutual aid during times of need. Resumen: Durante la comisión de un crimen, testigos o víctimas, expuestos al habla del agresor pueden ser llamados, en forma posterior, a reconocer la voz de quien se sospecha es el autor del delito, con el fin de establecer si ellos la reconocerían como la voz del delincuente. Un ejemplo de esta situación, donde se vio involucrado el testimonio de testigos auditivos, fue durante el proceso del caso de Emilio Berkhoff, el joven universitario que fue declarado culpable de los delitos (...) de porte ilegal de armas y municiones y condenado a cinco años y un día de cárcel. El caso no estuvo exento de cierta controversia debido a las declaraciones públicas del imputado sobre supuestas violaciones al debido proceso. En este trabajo se revisa el procedimiento ocupado para la recolección de la evidencia auditiva a la luz de los criterios más ampliamente compartidos sobre la materia.: During the commission of a crime, witnesses or victims, exposed to the speech of the aggressor can be called, later, to recognize the voice of the person suspected of being the perpetrator of the crime, in order to establish whether they would recognize it as the voice of the offender. An example of this situation, where the testimony of hearing witnesses was involved, was during the case of Emilio Berkhoff, the young university student who was found guilty of the crimes of illegal bearing of arms and ammunition and sentenced to five years and one day in jail. The case was not exempt from some controversy due to the public statements of the accused about alleged violations of due process. In this paper we review the procedure used to collect the auditory evidence in light of the most widely shared criteria on the subject. (shrink)

Resumen: Este artículo tiene como foco de estudio la fonología segmental del mapudungun, en general, y el estatus de los fonos interdentales /en el chedungun hablado en Alto Biobío, en particular. Se elicitó una lista léxica adaptada de Croese, 30 colaboradores adultos, bilingües de chedungun y español, pertenecientes a 10 localidades pehuenches de esta comuna. Mediante evidencia cuantitativa, visual, palatográfica y de contraste en ambiente análogo, se concluye que dichos fonos tienen estatus fonémico en la zona señalada.: This article focuses (...) on the Mapudungún segmental phonology in general, and the status of the interdental phones / from the Chedungun spoken in Alto Biobío in particular. An adapted lexicon list by Croese was elicited from 30 adult bilingual assistants, belonging to 10 towns of this community. Through the quantitative, visual, palatographic and analog environment contrast we concluded that those phones have phonemic status in the mentioned area. (shrink)

Self-enhancement is the biasing of one’s view of oneself in a positive direction. The brain correlates of self-enhancement remain unclear though it has been reported that the medial prefrontal cortex may be important for producing self-enhancing responses. Previous studies have not examined whether the neural correlates of self-enhancement depend on the particular domain in which individuals are enhancing themselves. Both moralistic and egoistic words were presented to participants while transcranial magnetic stimulation was applied to the MPFC, precuneus or in a (...) sham orientation. Participants were asked to make decisions as to the words describing themselves, some of which were positive and some of which were negative. It was found the MPFC TMS significantly disrupted egoistic self-enhancement when TMS was delivered to the MPFC. Judgments involving moralistic words were not influenced by TMS. These data provide further evidence that MPFC is involved in self-enhancement, and that the role of MPFC may be selective in this regard. (shrink)

In order to improve the management of copyright in the Internet, known as Digital Rights Management, there is the need for a shared language for copyright representation. Current approaches are based on purely syntactic solutions, i.e. a grammar that defines a rights expression language. These languages are difficult to put into practise due to the lack of explicit semantics that facilitate its implementation. Moreover, they are simple from the legal point of view because they are intended just to model the (...) usage licenses granted by content providers to end-users. Thus, they ignore the copyright framework that lies behind and the whole value chain from creators to end-users. Our proposal is to use a semantic approach based on semantic web ontologies. We detail the development of a copyright ontology in order to put this approach into practice. It models the copyright core concepts for creation, rights and the basic kinds of actions that operate on content. Altogether, it allows building a copyright framework for the complete value chain. The set of actions operating on content are our smaller building blocks in order to cope with the complexity of copyright value chains and statements and, at the same time, guarantee a high level of interoperability and evolvability. The resulting copyright modelling framework is flexible and complete enough to model many copyright scenarios, not just those related to the economic exploitation of content. The ontology also includes moral rights, so it is possible to model this kind of situations as it is shown in the included example model for a withdrawal scenario. Finally, the ontology design and the selection of tools result in a straightforward implementation. Description Logic reasoners are used for license checking and retrieval. Rights are modelled as classes of actions, action patterns are modelled also as classes and the same is done for concrete actions. Then, to check if some right or license grants an action is reduced to check for class subsumption, which is a direct functionality of these reasoners. (shrink)

Las actividades de fomento de la cultura científica se han convertido en una práctica habitual de las instituciones de investigación, que destinan presupuesto y recursos humanos a este objetivo. Cada vez más personal científico y técnico incorpora esta misión a sus tradicionales tareas de investigación y formación. Sin embargo, mientras la investigación y la docencia cuentan con indicadores establecidos, las actividades de divulgación siguen estando consideradas como un ejercicio extraordinario, pocas veces reconocido institucionalmente. En este sentido, el uso de unos (...) indicadores de cultura científica contribuiría a favorecer un cambio de mentalidad y a la obtención de datos objetivos sobre los que orientar las acciones de comunicación social de la ciencia. En este contexto, el Consejo Superior de Investigaciones Científicas (CSIC), a través de su Vicepresidencia Adjunta de Cultura Científica, se ha propuesto analizar las actividades desarrolladas en esta línea, entre 2011 y 2019, en relación a los siguientes indicadores: 1) la inversión económica; 2) el personal dedicado a cultura científica; 3) el número y tipo de actividades; y 4) el público al que se llega. Entre las principales conclusiones, destaca que el CSIC cuenta con una masa crítica más o menos estable de unas 200 personas que se dedican a tareas de cultura científica. Cada año se realizan alrededor de 15.000 actividades (presenciales y no presenciales) en las que se implican alrededor de 3.000 trabajadoras y trabajadores del CSIC. Cada año participan cerca de un millón y medio de personas de manera presencial. (shrink)

Vital events, such as widowhood and retirement, are broadly accepted as points of inflection in the lives of older adults that often differ according to gender. In this study, we analyzed the influence of gender differences in meaningful leisure among older adults through the integration of qualitative and quantitative findings. The use of joint displays revealed that: (1) there is no significant difference between the influence of retirement and widowhood on the two genders, (2) the ethic of care is a (...) constraining factor in older women’s leisure, (3) women are more innovative in their leisure in older age, and (4) volunteer activities are highly segregated by gender. The use of joint displays helped illuminate these four phenomena in light of quantitative and qualitative data. (shrink)

Virtual reality is a useful tool to study consumer behavior while they are immersed in a realistic scenario. Among several other factors, personality traits have been shown to have a substantial influence on purchasing behavior. The primary objective of this study was to classify consumers based on the Big Five personality domains using their behavior while performing different tasks in a virtual shop. The personality recognition was ascertained using behavioral measures received from VR hardware, including eye-tracking, navigation, posture and interaction. (...) Responses from 60 participants were collected while performing free and directed search tasks in a virtual hypermarket. A set of behavioral features was processed, and the personality domains were recognized using a statistical supervised machine learning classifier algorithm via a support vector machine. The results suggest that the open-mindedness personality type can be classified using eye gaze patterns, while extraversion is related to posture and interactions. However, a combination of signals must be exhibited to detect conscientiousness and negative emotionality. The combination of all measures and tasks provides better classification accuracy for all personality domains. The global precedence effect, originally referring to processing hierarchical visual stimuli composed of letters, is characterised by both global advantage and global interference. We present herein a study of how this effect is modulated by the variables letter and sex. The Navon task, using the letters “H” and “S,” was administered to 78 males and 168 females. No interaction occurred between the letter and sex variables, but significant main effects arose from each of these. Reaction times revealed that the letter (...) “H” was identified more rapidly in the congruent condition both in the global and the local task, and the letter “S” in the incongruent condition for the local task. Also, although RTs showed a GPE in both males and females, males displayed shorter reaction times in both global and local tasks. Furthermore, luteal women showed higher d’ index in the congruent condition for the local task than both follicular women and hormonal contraceptive users, as well as longer exploration time of the irrelevant level during the global task than males. We conclude that, according to the linear periodicity law, the GPE is enhanced for compound letters with straight vs. curved strokes, whereas it is stronger in males than in females. Relevantly, luteal phase of the menstrual cycle seems to tilt women to rely on finer grained information, thus exhibiting an analytical processing style in global/local visual processing. (shrink)
